What is supposed to be in your copyright then? On your version it
clearly says you used a free template. This free template is free for
the new designer too I'd think. As for the code itself, the new one
uses Wordpress - entirely different code from what you built.

Modified it.
And mentionned a copyright in the footer, with reference of the
initial free template.
To my modest opinion, a modification of code can be copyright
protected...if original source is mentionned (as requested by original
manufacturer)
Whatever software you use to set up HTML code, CSS code can be copied.

He probably wouldn't have guessed the reference was a prerequisite.
Tell the client this, so he can change it.
Please do have a look to the CSS code in both cases.
That would require me to download your CSS code, the new design's CSS
code *and* the orignal CSS code, and sorry, I'm too busy for that. The
only obvious thing I can see is the green background colour, that was
not part of the mint/chocolate template. I'd imagine the client liked
that colour though, and told the new designer to use it. All the other
stuff on the page is either different from your design, or the same as
the original template.

automatically copyrighted if you are the maker of it.

You'd have to prove that a) he didn't revamp the original template
instead of yours, and b) that your code is older than his.

Yes. And if I'd get half a cent for anyone who copies (or appears to
have copied) bits and pieces from my CSS files, I'd be rich. (not that
anyone copies my code afaik, but similarities are bound to be found)

But the new designer hasn't used the free template -- he's recreated
the layout using his own system, which is perfectly permissible (and,
in fact, common practice). There is no copyright infringement
AFAICS, as the layout in question is a fairly common one. It might
be nice to reference the free template which he has reference for his
visual design, but he is under no obligation to do so. A request for
a reference from the designer of the free template is exactly that --
a request.

I don't see an issue here. It's similar, and maybe he/she based it off
your site, but there are many differences to which he can refer.
I've had two of my designs stolen (that I know about), and in one case
they forgot to change the "Website Development by....." at the bottom of
the page. I found out about the site because a client called me last
year referring to the stolen site, liked what he saw and wanted me to
redesign his site.
Until the thief changes that tag line, I'm not saying anything.
