"Out of Bounds" Datagrid Scroll Bar

I keep getting an out of bounds error message when I have selected the last record on the datagrid (by code) then try and move up in the datagrid using the scroll bar. I dont have any code to naviagate the datgrid by use of the scroll bar so I dont know why I am getting an error.

If it is unselected I have no errors. Any thoughts or commends would be appreciated.
