Check if file is open and if it is unlock and delete

Question one:

How do you detect if a file is locked. I have a program that is
cleaning up a temp directory and I want to scan the files to see if
they are locked before I try to delete them.

Question Two:

If the file is locked and I have admin privilages how do you take
ownership of the file and then delete it?
