that’s an issue with the MDB2 PEAR package, which is written to support PHP 4.

the code is most likely along $some_var &= new SomeClass();, which is, as stated, deprecated in PHP 5.

your best bet is to not use MDB2 since as of PHP 5.1 there is the native PDO that does the same.
