javscript error 5003:cannot assign to a function result !! cant get rid of it!

i have the following code in a .jsp file:

in Tabs.js i create a TABS_LOADER object using:
LOADER = new TAB_LOADER();

only to get a "cannot assign to a function result" error!!
wazzza problem?
