I want to open a form from a control on a maximised form, but I don't
want the second form to be maximised. I've tried using
DoCmd.RunCommand acCmdSizeFitToForm but it will only work if the first
form is not maximised. Is there a way around this?

Open your second form in Dialog mode.
It will not be maximized, and will stay on top of the first form.
Of course, you will not be able to interact with the first form until
the second one is closed.
